Terms & Conditions - Students

1 - Information about us and how to contact us
1.1 - Who we are. Hybr (“we” and “us”) is a company registered in England and Wales and our registered office is at 101 Blenheim Crescent, W11 2EQ, trading as HYBR.
1.2 - Contacting us. To contact us telephone our customer service team at +44 20396 64594 or email us at hello@hybr.co.uk.
1.3 - How we may contact you. If we have to contact you, we will do so by telephone or by writing to you at the email address you provide to us in your registration, or through the messaging service of Our Platform. Please let us know if these change and update us :)
1.4 - Language. These Terms and the Contract are made only in the English language.
1.5 - Your copy. You should print a copy of these Terms or save them to your computer for future reference.
2 - Using and storage of your information
2.1 - By accepting these terms, you agree to us using your information for the purposes of securing a tenancy and facilitating contact with you as landlords and tenants for the duration of a tenancy.
2.2 - We may keep your personal data and use it where we have legitimate interest to do so. For example, any records we need to keep for regulatory reasons. For more information on how we use your data, please see our Privacy Policy.
2.3 - We’ll send you email and/or SMS notifications whenever we receive an important update on the platform.
2.4 - Please keep your account details safe and secure. We will never ask for the password to your account. If we discover any security issues affecting your account, we’ll contact you as soon as possible
2.5 - If you lose access to your account, you can make a ‘forgotten password’ request and change it via a link in your email.
2.6 - If you ever have any issues accessing your account or are unsure why we’re requesting certain information, please contact us as soon as possible.
2.7 - You agree that we may suspend access to the Platform temporarily and without notice in the case of system failure, maintenance or repair or for reasons beyond our control and we shall not be liable to you in any way for such suspended access.
2.8 - If you no longer wish for us to use your information, we’ll have to cancel your subscription and close your account.
3 - HYBR services
We will supply services relating to the student rental accommodation including dealing with enquiries, arranging property viewings, carrying out guarantor checks, organising tenancy agreements, collecting your deposits on behalf of the landlord and in some instances, we may provide property maintenance services.
3.1 - Arranging property viewings - we will put you in touch with either the landlord or lead tenant and he/she shall arrange a viewing for you. In case of non availability of the landlord/lead tenant, one of our staff members will show you around the property on behalf of the landlord.
3.2 - Tenancy agreement
3.2.1 - The Tenancy agreement is provided to you on your registered Email and you shall sign on the same using Docu- sign.
3.2.2 - You need to provide a scan copy of your passport along with the signed agreement.
3.2.3 - A final copy of the Tenancy agreement which is signed by all the parties is issued to all the interested parties.
3.2.4 - Our agreement is suitable to most ordinary lettings but you may require legal advice to satisfy you of any additional clauses that you wish to add. You may also use your own tenancy agreement, however, we accept no responsibility or liability for the content of this agreement.
3.2.5 - Signing a tenancy agreement means you are legally bound to the terms of the agreement and any violation will amount to breach. Hence, we suggest you read the terms carefully before signing it.
3.4 - Collection of Rent
Rent is paid to the Landlord and we do not have any legal rights to negotiate with the rent amount.
3.5 - Security Deposits
A security deposit equivalent to one month or 5weeks depending on the requirement of the Landlord, must be deposited either with HYBR/Landlord and we will deposit the paid amount with a Deposit Protection Scheme. Deposit amount is held against any rent that is due or damages caused to the property during the tenancy period.
3.6 - Guarantor checks and Guarantees
3.6.1 - Providing Guarantor details is up to the landlord, whether they require a guarantor check from you.
3.6.2 - Incase the landlord needs a guarantor check we do it on their behalf and we need the following details as a part of our guarantor check.
- They must be residing in the UK and have a UK bank account.
- The address of the guarantor and their proof of residence.
- The guarantor whose details you provide must be able to guarantee the lower of: The total sum of rent payable by you to your landlord over the period of one year; or The total sum of rent payable and Deposit by you to your landlord over the period of your tenancy if your tenancy is less than one year.
3.6.3 - In instances where you are not able to provide a guarantor situated in the UK, you will be required to pay 6 months rent or the whole rent upfront. Or you can use a private or public guarantor scheme.
3.7 - Property maintenance services
3.7.1 - We will supply our trusted maintenance workers, including plumbers, gardeners, electricians, cleaners etc. if our landlord or students need assistance.
3.7.2 - For any emergency issues, we highly recommend the tenant(s) contact the landlord directly.
3.8 - Tenant Fee
HYBR never charges any fees to tenants. If renting a property with HYBR, you may be required to pay a deposit, holding deposit and/or rent through the platform.
4 - Student obligations
4.1 We are a platform that provides accommodation only to students and the information you provide must be correct. we may suspend your account and withdraw our services, if it comes to our knowledge that false information has been given to us. We also have a right to legally proceed against you in the said situation.
4.2 You are requested to sign in using your university email address and submit a copy of your student id when required.
4.3 It is expected that the students maintain good conduct during the tenancy period and do not involve in any illegal activities.
4.4 We are not responsible for any financial loss as a result of any direct action taken or information provided to external parties by you unless such loss is a result of our negligence.
4.5 - Prohibited Behaviour
You agree that by using the Platform, you will not engage in behaviour that will, include, but not be limited to:
4.5.1 - Putting us in a position where HYBR may break the law
4.5.2 - Breaking the law or attempting to break the law
4.5.3 - Being abusive to or harassing anyone at HYBR or another member of our staff.
4.5.4 - To publish, post, upload, store, distribute or disseminate any unlawful, defamatory, infringing, obscene, sexually explicit, harmful, confidential, libellous, hateful, threatening or otherwise illegal material or information, or anything which might constitute a criminal or civil offence
4.5.5 - Uploading files that contain software or other material which are the Intellectual Property Rights of any third party, or which are protected by rights of privacy or publicity of any third party without having received all necessary consents
4.5.6 - Using software or any other means to harvest information from the Platform
4.5.7 - Not doing or omitting to do anything that, in our opinion: (i) brings us or the Platform into public disrepute, contempt, scandal or ridicule; (ii) damages or puts at risk any other users of the Platform; or (iii) materially prejudices us or the Platform.
4.5.8 - Sending chain letters, junk mail, spamming material, any form of unsolicited advertisement or any other form of bulk communication
4.6 - You agree to comply with all reasonable instructions that we may give you regarding your use of our Platform.
5 - Properties listed on HYBR
5.1 - We are a student rental accommodation’s listing platform. We only list the properties on behalf of the landlord and we do not own any properties that are listed on our website.
5.2 - Any descriptions or illustrations on our site are published for the sole purpose of giving an approximate idea of the services described in them. They will not form part of the Contract or have any contractual force.
5.3 - We are not responsible for any incorrect details provided by the landlords. Students are recommended to inspect the property physically and notify us about issues with the property before or on the day of signing the Tenancy agreement. The landlord is liable for such misrepresentation and we are not liable to any false information given by the landlord.
Blogs
We are not liable for the advice we give on our blogs. Our blogs are part of our platform where we advise students on house-hold issues. We support students with rental issues through our customer service and blogs.
How to make a complaint
We will always do our best to help resolve any issues you may have. If you have a complaint, please contact us and we’ll do our best to fix the problem. You can directly contact one of our directors via email at hannah@hybr.co.uk if you’re unhappy with the service you have received.
In accordance with Section 83 of the Consumer Rights Act 2015, we are a member of the Consumer Redress Scheme operated by the Property Redress Scheme. They can be contacted by phone on 0333 321 9418 and you can find out more about them at www.theprs.co.uk. The PRS will not deal with a complaint unless you have first raised the issue with us and given us a reasonable timeframe to respond. Our PRS membership number is PRS024356.
We have client money protection which is provided as a result of our membership with Client Money Protect. Our membership number is CMP008145.
